A U.S. Appeals Court has ruled that weed industry workers are entitled to workplace protections.
The decision was handed down late last week in a case involving a security guard for a Colorado-based security company.
The company, which provides security services to cannabis companies, tried to have the case dismissed by using some twisted logic. The company’s lawyers argued that the court had no jurisdiction to hear the case. That’s because, well, cannabis is not legal under U.S. federal law.
The court disagreed. “Employers are not excused from complying with federal laws just because their business practices are federally prohibited,” the court ruled.
It’s a landmark decision that experts hope will pave the way for more protections for workers in a cannabis industry fighting for legitimacy.
