In the United States, there is a two-step process to open a marijuana dispensary. One will be on a local level, and the other will be on a state level. At the state level, you want to organize your business as a collective or cooperative. Through the board of equalization, you’ll have to apply for all the necessary licenses and permits. This will also include the franchise tax board.

Then as your business grows, you may wish to hire employees. In order to do that you’ll have to apply for an EIN number. You’ll need to obtain one in order to hire employees. Your documentation is then submitted to the Employment Development Department. Then after this process, and once it has been set up properly with the state, you then look to the local level, the different cities, and counties where you wish to operate. Do your research to find out if those cities or counties will allow medical marijuana dispensaries to be set up. If they do, then you go through the process of applying for a medical marijuana dispensary license in that city or county. This entire process will depend upon if you’ve met the requirements for the location you wish to set up in. During this process, you may encounter a “setback”. What this ensures that through the successful meeting of the location requirements, that said location for the marijuana dispensary is a certain distance away from schools and school zones. Under state law, the setback is at least 600 feet from a school or school zone. And some localities do require more than 600 feet. In the city of Los Angeles for example, you cannot be within 1,000 feet of a school or school zone and be a medical marijuana dispensary.

In conclusion, if you’ve gone through the process correctly, and have accounted for every single municipality and every single governmental institution you’ll be required to deal with, then and only then will you successfully be able to operate and run your own medicinal medical marijuana dispensary within the bounds of each state law.
